Terms of Use and Privacy Policy
This Policy sets forth SAC Wireless’ (“SAC”) terms of use and privacy policy, and describes Our policies and procedures on the collection, use and disclosure of Your information and tells You about Your privacy rights and how the law protects You.
By accessing SAC Express (“Application”) You agree to the following terms, which are made available during sign in to access the Application and are available on the Terms of Use and Legal Tab section of the Application. If You do not agree to the following terms, do not use the Application.
Contents
The contents of Application contain copyrighted materials owned by, or licensed to SAC or its affiliates and are protected by applicable laws. All intellectual property rights in the Services remain the sole and exclusive property of SAC. Any rights not expressly granted herein are reserved. Reproduction, transfer, distribution or storage of part or all of the contents in any form without the prior written permission of SAC is prohibited except in accordance with the following terms. SAC does not consent to You printing copies of extracts from this Application and You may only do so if consented to in writing by SAC. Individual documents in our Application may be subject to additional terms indicated in those documents.
Use of the Application
The Application and its contents are intended for use by SAC’s customers and prospective customers in the United States. The Services may not be used in any way that violates any applicable federal, state, local, or international law or regulation. You may not use the Application for any commercial purpose other than to engage SAC for services.
You agree not to: (a) modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Application; (b) use any robot, spider, or other automatic device, process, or means to access the Application; (c) introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful; (d) attack the Application via a denial-of-service attack or a distributed denial-of-service attack; or (e) otherwise attempt to interfere with the proper working of the Application.
User Accounts
To access certain features of the Application, You may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that You use to access the Application and for any activities or actions under Your password. SAC cannot and will not be liable for any loss or damage arising from Your failure to comply with the above requirements.
Submission of Requests
When you submit a request for services through the Application, You acknowledge and agree that all information provided is accurate and complete to the best of Your knowledge. SAC reserves the right to accept, reject, or modify any service request at its sole discretion. Estimates provided are non-binding until a formal agreement is executed by both parties.
Payments
Payment terms will be specified in the project estimate and any related agreements. Depending on the quote value and scope of work, We accept standard purchase orders, checks, or ACH transfers. To activate a project, payments in full or deposits (based on scope of work) may be required upon acceptance of the estimate. Late payments may incur fees as set forth in the applicable agreement.
Disclaimer of Warranties
THE APPLICATION AND ALL CONTENT, MATERIALS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SAC DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APPLICATION, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to defend, indemnify, and hold harmless SAC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to Your violation of these Terms or Your use of the Application.
